LIMITED INSTRUMENT WARRANTY

Subject to the conditions incorporated in this Limited Warranty, ELITechGroup warrants that the instrument will be free from defects in material and workmanship for a period of twelve (12) months from the date of installation or fifteen (15) months from date of shipment, whichever occurs first (the “Warranty Period”). This Limited Warranty will be void on any instrument that (1) is damaged in transport or as a result of accident, fire, vandalism or other casualties; (2) shows evidence of abuse, lack of proper maintenance, improper installation, alteration in any way from the original design, including installing unauthorized software, hardware, accessories or components or negligence in use; (3) is used with reagents, controls, spare parts, or other consumables that are not authorized in writing by ELITechGroup; (4) is adapted, modified, or adjusted in any way to comply with local or national regulations different from those for which the instrument was originally designed or manufactured; or (5) used by untrained operators. Warranty service will be performed at ELITechGroup’s sole discretion, either at the end-user’s facility or at an ELITechGroup repair facility. An instrument designated by ELITechGroup for depot repair must be delivered in a clean and uncontaminated state with freight prepaid to: ELITechGroup Inc., 370 West 1700 South, Logan, UT 84321, United States. The sole responsibility of ELITechGroup under this warranty is expressly limited to the repair or replacement of an instrument during the Warranty Period. In the event that the instrument is replaced as a subject of this Limited Warranty, ELITechGroup shall impose a “fair use” charge to be determined by ELITechGroup in its sole and reasonable discretion. This Limited Warranty is nontransferable and does not apply to fluid handling devices of any kind, or to consumables or reagents. ELITechGroup is not responsible for injury, property damage or other consequential damages of any kind arising directly or indirectly from any actual or alleged defects in material and/or workmanship of the instrument. No person other than ELITechGroup shall have the right to determine whether or not this Limited Warranty is applicable. This Limited Warranty is in lieu of and expressly excludes any and all other warranties, express or implied, including, without limitation, warranties of merchantability or fitness for a particular application or purpose. In the event of any conflict between this Limited Warranty and any other instrument, representation or warranty, whether oral or written, the terms and conditions of this Limited Warranty shall take precedence and control for all purposes.
